Court of Appeal Validates Ahmed Ododo as APC Candidate for Kogi State Governorship Election

In a significant development, the Court of Appeal in Abuja has affirmed Ahmed Ododo as the legitimate candidate of the All Progressives Congress (APC) for the upcoming governorship election scheduled in Kogi State on November 11.

The unanimous decision came from a three-member panel of Justices, upholding the Federal High Court’s ruling in Abuja. This ruling validated the primary election that resulted in Ahmed Ododo being chosen as the APC’s flag-bearer for the gubernatorial race.

The Court of Appeal dismissed separate appeals brought by two dissatisfied governorship aspirants within the party, namely Senator Smart Adeyemi and Mr. Abubakar Achimugu.

Justice Muhammed Shuaibu, leading the panel, declared that both appeals lacked substance. He stated that the appellants failed to substantiate their claims, including the assertion that Ododo’s emergence was from an illegitimate primary election. Additionally, the court held that Senator Adeyemi’s criminal allegations required stronger evidence to be proven beyond reasonable doubt.

Justice Shuaibu emphasized that the burden of proof rested on the appellants, who alleged irregularities in the APC’s Kogi state primary election. He also noted that the APC presented ample evidence in the trial court to validate the outcome of the primary vote.

Given that the evidence from the respondents went uncontested by the appellants, the court resolved the first issue against the appellants.

This decision solidifies Ahmed Ododo’s position as the APC candidate and underscores the legal integrity of the primary election process.”
